Tom Homan, the Trump administration’s self-declared “border czar,” has found a new target: Representative Alexandria Ocasio-Cortez. In a flurry of media appearances, he has accused her of interfering with law enforcement efforts, suggested she should face legal repercussions, and—just for good measure—called her “the dumbest congresswoman ever elected.”
It all started when AOC hosted a virtual “Know Your Rights” webinar for her constituents, many of whom are immigrants. Instead, Homan took to Fox News and CNN, floating the idea that she was aiding and abetting undocumented immigrants and calling on the Department of Justice to investigate her.

The Trump administration has no shortage of critics, so why does AOC get singled out time and time again? Part of it is obvious: She’s a young, vocal Latina from New York who doesn’t back down from a fight. The optics of a powerful government official publicly threatening a Latina congresswoman for simply informing people of their rights are impossible to ignore.
According to The New Republic, Homan’s rhetoric isn’t about actual legal concerns—it’s about sending a message. By attempting to criminalize AOC’s efforts, he’s creating a chilling effect, hoping to make others—activists, legal advocates, and even fellow politicians—think twice before standing up to Trump’s immigration crackdown.
The Hypocrisy of Trump’s DOJ Threats
The situation gets even more absurd when you consider that this is the same administration that wants to shut down criminal investigations into Republican lawmakers accused of actual felonies. Meanwhile, Homan is demanding legal action against a congresswoman for reminding people they have constitutional rights. As MSNBC’s Steve Benen pointed out, it’s a blatant double standard.
Ocasio-Cortez isn’t having it. She fired back on social media, writing: “This is why you fight these cowards. The moment you stand up to them, they crumble. Homan has nothing. The Fourth Amendment is clear and I am well within my duties to educate people of their rights.”
Is This a Political Miscalculation?
For all of Homan’s bluster, he might have miscalculated. As MSNBC columnist Julio Ricardo Varela noted, his fixation on AOC could actually backfire. Latinos have been drifting away from the Democratic Party, frustrated by the lack of real action on immigration. But when they see AOC standing her ground and refusing to be intimidated, it’s a powerful moment. It signals that someone is willing to fight for their communities, even when it means going toe to toe with the Trump administration.
And AOC isn’t backing down. In an interview with MSNBC, she dismissed Homan’s attacks as desperate attempts to project strength where there is none. “The Trump administration understands that it does not have absolute power and that it must rely on creating a false illusion of power to create a chilling effect,” she said.
What Comes Next?
So far, there’s no indication that the Justice Department is actually taking Homan’s threats seriously. But in an administration stacked with Trump loyalists, that could change. If the DOJ does move forward with an investigation, it would set a dangerous precedent—one that could impact not just AOC but any lawmaker or advocate who dares to stand up to Trump’s immigration policies.
For now, AOC is turning the attacks into fuel. She’s made it clear she won’t be intimidated. And if Homan thought he could scare her into silence, he really did pick the wrong Latina.
